6. Prohibited Uses

6.1 You may only use Our Site in a manner that is lawful.  Specifically:

6.1.1 you must ensure that you comply fully with any and all local, national or international laws and/or regulations;

6.1.2 you must not transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);

6.1.3 you must not use Our Site in any way, or for any purpose, that is unlawful or fraudulent;

7.1 We may from time to time provide interactive services on Our Site, including, without limitation:

7.1.1 Chat rooms;

7.1.2 Bulletin boards; and or

7.1.3 Live chats. (“interactive services”).

7.2 Where We do provide any interactive service, We will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

7.3 We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on Our Site, and We will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, We are under no obligation to oversee, monitor or moderate any interactive service We provide on Our Site, and We expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

8.1 These content standards apply to any and all material which you contribute to Our Site (“contributions”) including customisation of resources requests, and to any interactive services associated with Our Site.

8.3 We will determine, in its discretion, whether a Contribution breaches the Content Standards.

8.4 Contributions must:

8.4.1 Be accurate (where they state facts).

8.4.2 Be genuinely held (where they state opinions).

8.4.3 Comply with applicable law in the UK and in any country from which they are posted.

8.5 Contributions must not:

8.5.1 Contain any material which is defamatory of any person.

8.5.2 Contain any material which is obscene, offensive, hateful or inflammatory.

8.5.3 Promote sexually explicit material.

8.5.4 Promote violence.

8.5.5 Promote discrimination.

8.5.6 Infringe any copyright, database right or trade mark of any other person, organisation, company or entity.

8.5.7 Be likely to deceive any person.

8.5.8 Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.

8.5.9 Promote any illegal activity.

8.5.10 Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.

8.5.11 Be likely to harass, upset, embarrass, alarm or annoy any other person.

8.5.12 Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.

8.5.13 Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

8.5.14 Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.

8.5.15 Contain any advertising or promote any services or web links to other sites.

9. Breach Of This Policy

9.1 We reserve the right to suspend or terminate your access to Our Site if you materially breach the provisions of this Clause 9 or any of the other provisions of these Terms of Use.  Specifically, We may take one or more of the following actions;

9.1.1 suspend, whether temporarily or permanently, your right to access Our Site;

9.1.2 issue you with a written warning;

9.1.3 take legal proceedings against you for reimbursement of any and all relevant costs on an indemnity basis resulting from your breach;

9.1.4 take further legal action against you as appropriate;

9.1.5 disclose such information to law enforcement authorities as required or as We deem reasonably necessary; and/or

9.1.6 any other actions which We deem reasonably appropriate (and lawful).

9.2 We hereby exclude any and all liability arising out of any actions (including, but not limited to those set out above) that We may take in response to breaches of these Terms and Conditions.
